General Terms
The present portal 'www.rentaroof.in' including its domain name and mobile application is exclusively owned, controlled and operated by M/s Blue Reef Real Estate Pvt. Ltd. hereinafter referred to as the 'Company'
By using the present portal, domain and/or mobile application, the User(s) hereby agree to comply with and be bound by the following terms and conditions ("Terms of Use") including our privacy policy and any other documents referred to therein.
It becomes the responsibility of the User(s) to read the terms and conditions herein including the privacy policy uploaded separately on the present portal and make sure they agree with it before using the portal and/or availing services of the Company. On the contrary if users do not agree to the terms and conditions, they may kindly refrain themselves from using the present web portal, domain and/or mobile application or using, subscribing to the services offered by the Company and also to restrict from sharing any kind of information. In so far as the User(s) complies with the present terms and policy as stated above, he/she is granted a personal, non-exclusive, non-transferable, revocable, limited privilege to enter, access and use the portal/mobile application. In breach of the present terms including the privacy policy of the portal by the User(s), the Company herein reserves its right to bar or restrict the User(s) from continuing to use the same or availing the services offered by the Company without any prior intimation.
The Company reserves its rights to amend these Terms of Use including the privacy policy from time to time due to improvements, amendments in laws or for any other reasons not stated herein at the sole discretion of the Company without prior notification to the User(s). Users to make sure to go through the terms and privacy policy every time they use, subscribe, and/or share information on the present web portal or its ancillary mobile application as the present terms acts as a legal binding contract between the User(s) and the Company. Any other service(s) that the Company offers to its User(s) may also be subject to additional or alternative terms and conditions with us or with other third parties.
Nothing in the present terms shall mean to constitute a partnership, joint venture or agency relationship between the Company and its User(s).
Any delay on behalf of the Company to enforce the present terms or any other alternate remedy against its User(s) shall not constitute or be construed to waiver of such right. The Company shall not be responsible for breach of the present term(s) which are beyond the control of the Company.

By expressing interest in any property listing or related services on Rent A Roof, you explicitly authorize Rent A Roof to contact you via phone, SMS, email, or WhatsApp—even if you are registered under NDNC/DNC (National/Do Not Disturb registries). You also consent to provide your personal information, including your contact details and any documents you may share, to Rent A Roof. This information will be accessed and used by Rent A Roof’s authorized team members, including agents and support staff, for the purpose of assisting you with your property inquiry or service request.

Every owner listing will be assigned a Rentaroof agent/affiliate, who will handle enquiries, screening tenants, house showings, formation of lease, and other transactional support etc.

Our service and their use is voluntary. Please note that if you do not provide us with the required information, we may not be able to provide the requested services.

We recognise our responsibilities in relation to the collection, holding, processing or use of any data submitted by you. Data will be collected only for lawful and relevant purposes. We will take all practicable steps to ensure security of the data and to avoid unauthorised or accidental access, erasure or other use in furtherance of our Privacy Policy.
Access To The Portal, Mobile Application/Registration
User(s) must be 18 years old or over and must also comply by the terms of the Indian Contract Act, 1872 and all applicable laws, to have access to the present web portal and/or its mobile application and to create an account on our web portal. User(s) undertakes that the details they provide on registration or otherwise are correct, accurate, complete and current. User(s) further undertake to immediately update us with any changes to their account details. User(s) also undertake to set a password when they register and are solely including their agents responsible for maintaining the confidentiality of the same. User(s) shall make sure not to lead unauthorised access to their account through any device that they use to access their account. User(s) to contact the Company immediately If they believe unauthorised access to their account.
At the time of creating account User(s) may opt to receive marketing communications from the Company or its affiliates or authorised third parties. User(s) can manage their email subscription preferences vide the present portal and/or mobile application and can also unsubscribe anytime.
User's obligations (distribution, use and uploading of illegal information)
The User agrees and acknowledges that he/she is a restricted user of this Website, and that he/she:

is bound not to transfer or sell, cut, copy, distribute, modify, recreate, reverse engineer, distribute, disseminate, post, publish or create derivative works from, any information or software obtained from the Website. Any such use / limited use of the Website will only be allowed with the prior express written permission of the Company. For the removal of doubt, it is clarified that reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information contained on the Website is expressly prohibited.

The Company reserves its right to initiate action against the source of the same whilst the Company disclaims any and all liabilities arising in relation to such offensive content on the Website. The User expressly agrees and acknowledges that the properties/products/services displayed on the Website are not owned by the Company/Website itself, and that the same are the exclusive property of certain third parties who have chosen to market their properties/products/services through the Company's Website, and that the Company/Website is in no way responsible for the content of the same. The User may however report any such offensive or objectionable content, which the Company may then remove from the Website, at its sole discretion.

In places where the Website permits the User to post or upload data/information, the User undertakes to ensure that such material is not offensive or objectionable, and is in accordance with applicable laws. The User expressly agrees that any such material that is deemed to be objectionable/offensive may be removed from the Website immediately and without notice, and further that the User's access to the Website may also be permanently revoked, at the sole discretion of the Company.

Post any image/file/data that infringes the intellectual property rights of another person or legal entity;

The User may not reverse look-up, trace or seek to trace any information relating to any other user of, or visitor to, the Website, or any other customer of the Website, including any user account maintained on the Website not operated/managed by the User, or exploit the Website or information made available or offered by or through the Website, in any manner;

User shall continue to be responsible for the transactions in the user account, if user knowingly or negligently (i) grants any other person access to the user account on website/app. (ii) permit them to transact on their user account, or (iii) transact on any other person’s behalf or directions; whether by sharing one-time passwords or in any other manner.

User shall provide consent to automatically receive updates such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, ‘Updates’), for the purpose of effective delivery of the company services. Please note that user’s continued use of the website/app following such updates would mean deemed acceptance of the present terms of use by the user of the same.

Users understand and accept that not all products, services and rewards offered on the Website/App are available in all geographic areas and users may not be eligible for all the products, services and rewards offered by the company on the Website/app or on any other company Platforms. Company reserves the right to determine the availability and eligibility for any product, services and rewards offered on the Website/App or any other platform.

User shall request the company to block the Account and change the passcode immediately for the account, if the user's device has been lost or stolen.

Users agree to use website/app features only for the intended purposes and not for earning any fraudulent cash back, money laundering, terrorist financing, illicit payments or any other use which is either prohibited by law or is unethical.

The Merchants providing services that have the potential of casting the Payment Gateway Facilitators/Aggregator in a poor light and/or any other act leading to the liability including but not limited to unwarranted payment gateway/aggregator fees/charges, interest, penalties, chargeback and fraud losses;

IDs or documents which includes fake IDs, passports, diplomas, and noble titles;

Any product or service which is not in compliance with all applicable laws and regulations whether local or international, including the laws of India.

Violate any applicable laws, rules or regulations currently in force within or outside India

Violate any portion of these Terms or the Policy, including but not limited to any applicable additional terms of the Website contained herein or elsewhere, whether made by amendment, modification, or otherwise

Threaten the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or cause incitement to the commission of any cognizable offence, or prevent the investigation of any offence, or insult any other nation.

Publish, post, or disseminate information that is false, inaccurate or misleading;

Directly or indirectly offer, attempt to offer, trade, or attempt to trade, any item(s)/service(s) the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the tisme being in force.

Commit any act that causes the Company to lose (in whole or in part) the services of its internet service provider ("ISP") or in any manner disrupts the services of any other supplier/service provider of the Company

Engage in advertising to, or solicitation of, other users of the Website to buy or sell any products or services not currently displayed on the Website. The User may not transmit any chain letters or unsolicited commercial or junk email/messages to other users via the Website. It shall be a violation of these Terms to use any information obtained from the Website in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another user of the Website without the express prior written consent of the Company.

The User hereby expressly authorises the Company to disclose any and all information relating to the User in the possession of the Company to law enforcement or other government officials, as the Company may in its sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those involving personal injury and theft / infringement of intellectual property. The User further understands that the Company might be directed to disclose any information (including the identity of persons providing information or materials on the Website) as necessary to satisfy any judicial order, law, regulation or valid governmental request.

The User expressly agrees and acknowledges that the Company has no obligation to monitor the materials posted on the Website, but that it has the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms. That any listing (pertaining to property or any other service(s) uploaded by them on the present portal/mobile application are true, correct and not misleading and that they are authorised to list the same on the portal/app.

To comply with all the applicable laws, regulations, and industry standards related to their listings.

To indemnify and hold harmless the company, its affiliates, and its employees from any and all claims, damages, or liabilities arising from their listing(s).

That present Portal/mobile application may remove or edit their listing(s) at any time for any reason, including but not limited to violations of our terms of use or complaints from other user(s).

To pay the fees or commissions associated with the services availed through our platform.

Violation of User(s) obligation

If the company believes that the user has violated any of the conditions as mentioned under these Terms of Use, user obligation or Privacy Policy to certain services or any agreements consented to via the website, company reserve the right to suspend user access to the Website and/or delete user account without prior notice to user. However, users may reach out to the company support team to assist users with the restoration of the same.

Company herein reserves its right to terminate the present terms and/or any other agreement with the User(s) breaching any term of the same and avail any remedy as per applicable laws.

If the company has a reason to believe that there is suspicious or unusual activity being carried out through user account, company can take following actions against user:-

Ask the user to immediately refund an amount equivalent to any unwarranted charges paid by the company to any other payment gateway/bank due to such fraudulent transactions entered/acts committed by the user.

Charging of an amount equivalent to 3% as penalty of the amount transacted to the user. Further, the company reserves the right to increase the penalty amount, depending upon the severity/scale of the violation/fraud/misuse.

Temporarily or permanently suspend user access to the Website/application Services.

Charges
Browsing the web portal and/or its mobile application is cost free but the User(s) is required to pay for the services availed by the User of the Website and/or mobile application which stands payable. However, the Company reserves the right to amend this no-fee policy and charge the User for any or all services offered / rendered. In such an event, the User will be intimated of the same when he/she attempts to access the Website. The User(s) shall have the option of declining to avail the services offered on the Website. Any such change, if made, shall come into effect immediately upon such change being notified to the User(s), unless specified otherwise.
Mode of Payments
The following payment options are available on the Website:
- UPI (Unified Payments Interface): Users can make payments by transferring funds directly using UPI through the provided UPI ID.
- Net Banking/Direct Debit: Users may also choose to make payments via Net Banking or Direct Debit from their bank accounts.
- NEFT (National Electronic Funds Transfer) and RTGS (Real-Time Gross Settlement): Users can make payments using NEFT or RTGS through the provided bank account details. The transaction details, including beneficiary account number, IFSC code, and other necessary information, will be provided on the Website.
Payment Validation Process
Upon making a payment using one of the above methods, users are required to upload a screenshot of the payment for validation. The validation will be performed by the platform's admin or managing agent. The payment status will be updated/confirmed by the admin or managing agent based on the provided screenshot/payment details to the Company.
Security
The Company hereby assures its User(s) that the transactions on the Website are secure and protected. Any information entered by the User(s) when transacting on the Website is encrypted to protect the User(s) against unintentional disclosure to third parties.
For payments made through UPI, Net Banking, NEFT, and RTGS, the Company does not receive, store, or retain any payment-related information provided by the User(s). The User(s) directly share their payment details with the respective banks and payment services they choose to use. The Company does not have access to this information.
Disclaimer and liability
The web portal 'www.rentaroof.in' and the content/material available on it are provided on “As is” basis without any kind of warranties, either expressed or implied. The use of this web portal and/or its contents is at the User(s) own risk. The Company hereby disclaims warranties, either express or implied or otherwise including, but not limited to quality, accuracy, reliability, adequacy, completeness errors, title, non infringement or fitness for a particular purpose and any information contained therein on the portal. The Company does not warranty this web portal and/or its content/material free of bugs, viruses or other harmful components or that the present portal will operate continuously, be fault-free or without interruptions. The Company may be required to halt the services of the present portal with or without notice due to maintenance or other reasons for which the Company owns no liability for any interruption or loss of service. Users are subject to their own sole risks.
The information available on the present portal cannot substitute for independent professional advice and User(s) are advised to seek advice from related qualified professionals such as lawyers, architects, surveyors etc.. The Company shall claim no liability for any loss or injury suffered by the User(s) due to information provided on the present portal.
It is pertinent to mention here that the information about Property descriptions and/or any other information related to other product(s)/service(s) offered on the present portal are displayed in good faith by other User(s) but the Company shall not in any circumstances claim any responsibility for their accuracy. The Company owes no liability in case of direct or indirect loss of business, revenue or sales to its User(s) including but not limited to its in house paid brokers or external commission based brokers. It becomes the duty of the User(s) so as to verify about the accuracy of any property descriptions available on the portal.
The Company hereby claims no responsibility about the content of other web portals or links available on our portal. User(s) are required to check the terms and policies of such other website, advertisements before sharing their data there and in case of any claim arising thereof, the user(s) hereto indemnify the Company as the Company shall not be responsible for the same.
Indemnification
Users of the present portal indemnify and hold harmless the Company, its Director(s), its affiliates, employees, agents and/or representatives against, but not limited to, any/all claims, damages, costs, arising from and/or use of the present web portal/mobile application or any material/content and/or submissions provided by User(s) and claims by third parties in case of their infringement of material/content/submissions or otherwise.
Viruses, Bugs & other attack(s)
The Company herein does not guarantee that the present web-portal or its mobile application shall be secure or free of bugs/viruses. User(s) are responsible for browsing/using/availing services on the present portal/mobile application at their own risks. User(s) are strictly recommended to use their own virus protection software(s).
User(s) are restricted from knowingly introducing viruses, bugs, trojans or any other material which is technologically harmful to the present portal and/or its mobile application.
The Company shall not be liable for any loss or damage caused by a virus distributed or any other technologically harmful material that may infect User(s) device(s), computer program(s), data or other material due to User(s) use of present portal/mobile application or due to any downloading content on it, or any other website linked on the present portal and mobile application.
Intellectual Property
The web portal 'www.rentaroof.in' along with its mobile application comprises of contents/material/information including, but not limited to proprietary software(s), texts, scripts, sounds, photographs, music, videos, services, logos, trademarks, service marks etc. which is the intellectual property right (whether registered or unregistered) of the Company and the User(s) in no way shall acquire any right, title or interest in the same.
User(s) undertakes not to make commercial and/or unauthorised use of the content/material/information by means of publication, performance, transmission, distribution, caching, printing hard copies for distribution and selling or otherwise gained from the web portal. The content/material/information on web portal is for personal use only.
User(s) are hereby restricted from use of any automated program or other means to access the web-portal/mobile application for the purpose of collecting, copying, re-publishing, data or content on this portal/mobile application which shall be a breach of these terms of Use and may emanate consequences.
Users(s) agree not to post any content/material/information protected by copyright, trademark, trade secret or any other proprietary rights of third parties without prior express permission from the owner of such right.
Any material/content posted by the User(s) to be implied that such material/content is owned by the User(s) or permission from the owner has been taken, as the case may be. The Company herein reserves its right to remove/discard any infringing copyrighted/other Intellectual property right material/content/information by User(s).
User(s) undertakes that he/she shall be liable solely for any action, claim, damages resulting from infringement of copyright and/or other intellectual property rights by material/content posted by him/her and indemnifies the Company for any such action, claim, damages etc.
User(s) also grants the Company herein unrestricted royalty free non payable right to use, reproduce, publish, translate, transmit, display, distribute, perform or otherwise any material/content, posted by User(s), for any purpose including commercial uses.
User(s) agree not to post illegal, abusive, obscene, defamatory, threatening or otherwise objectionable material on the present web-portal/mobile application failing which stringent legal action shall be taken by the Company. Any personal/other data User(s) provide shall be governed by our Privacy Policy.
Any third party/User(s) aggrieved of infringement of his/her intellectual property right(s) may report to the grievance officer of the Company along with substantive piece of evidence at the details given below.
In compliance of above the Company hereby grants limited non-exclusive, non-transferable licence to use the web-portal/mobile application only to the extent necessary for use of the portal/app, and for no other purpose.
The Company hereby reserves its right, in its sole discretion and without prior notification to you, to terminate your licence and to prevent future access by you to this web-portal/mobile application.
Third Parties
The present portal/mobile application may contain links to third party products, services and/or their web portal(s) that have no concern with us. The Company herein has no control over the products, services or websites of these third parties and do not claim any guarantee or take responsibility for them. The present portal and/or mobile application also contains data provided by third parties and the Company herein accepts no responsibility for the same. User(s) agree to indemnify the Company from any claims or disputes of any kind arising from dealings with such third parties.
Temporary Suspension
The web portal 'www.rentaroof.in' along with its mobile application may at times be temporarily suspended for system maintenance, upgradation, hardware/software failure beyond the control of the Company, in that event the Company shall have no responsibility for any inconvenience or damages caused. User(s) are subject to their own sole risk.
Force Majeure
The Company shall be relieved of its obligation(s) to the extent that fulfilment of such obligation(s) shall be prevented by or delayed by circumstances beyond the reasonable control including, but not limited to, acts of God, governmental actions, acts of terrorism, protests, riots, war or national emergency, fire, explosion, flood, epidemic including any virus breakout, lockdowns, embargo, strikes or other labour disputes, or restraints or delays affecting carrier or inability or delays in providing products/services or suitable materials, hacker attacking, intrusion or attack of computer virus, temporary closure due to government regulation or otherwise.
Agreement
This agreement supersedes any prior agreement, whether written or oral. If you do not agree to the terms and conditions contained in this Agreement or Company's privacy policy, please stop using the services now.
Severability
In case any of the provision(s) of the present Terms of Use (at present or in future) is or shall be deemed unlawful, void, or for any reason unenforceable by any court, tribunal or administrative body of competent jurisdiction, then that particular provision(s) shall be deemed severable from the present Terms of Use and shall not render/affect the remaining provisions of present Terms of Use void/unenforceable or as the case may be and the remaining provisions shall continue to be in full force and effect.
Termination
The Company at its discretion may terminate the licence of the User(s) to use its web portal/mobile application without prior notice and to remove/discard any material/content on the web portal. The Company reserves the right to change, modify, alter, add or delete provision(s) of the terms and conditions including privacy policy and the updating of such terms and conditions/ privacy policy shall be deemed to be a notice to the User(s). User(s) are asked to view the terms and conditions every time they visit the present portal and mobile application which shall be deemed to be acceptable to the User(s) in case of its continued usage.

Governing Laws & Jurisdiction To Disputes
The terms herein are in accordance with the Information Technology Act, 2000 and comply by the laws of the land executed between the User(s) and the Company in Delhi, India.
In case of any dispute, the User(s) and the Company shall try to resolve the dispute amicably amongst themselves. In the event no resolution is reached within 90 days of either party communicating the existence of a dispute to the other Party, the dispute shall be subject to the laws of India and shall be triable subject to jurisdiction of Courts of law in Delhi, India.
Nothing in the present Terms of Use may prevent the Company from availing remedies and/or initiating proceedings in judicial/quasi judicial bodies of any jurisdiction other than Delhi, India.
